Chondromalacia
A 58-year old male suffered chondromalacia, lumbar and shoulder strains, and a knee contusion when his westbound vehicle was struck broadside by a nonparty eastbound vehicle when it veered into the opposite lane after it was struck from the rear by the female defendant’s eastbound vehicle, insured by the codefendant, on a public roadway. The plaintiff contended that the defendant operated her vehicle in negligent manner, failed to keep a proper lookout, and failed to maintain an assured clear distance. The plaintiff further contended that the codefendant issued a policy of insurance under which she was entitled to coverage. The defendants denied liability.
