A 33-year-old male engineer suffered a brain injury that resulted in decreased cognitive functions and ongoing cognitive deficits, and migraine headaches when his head struck the ice during a recreational hockey game in which he came into contact with the male defendant. The plaintiff contended that the defendant maliciously tackled him and threw him to the ground, causing his helmet to break into pieces, and that the defendant's negligence resulted in his permanent injuries. The defendant denied liability, disputed the extent of the plaintiff's injuries, and contended that the plaintiff provoked him into an altercation. The plaintiff's spouse filed a claim for loss of services and received $90,000. The plaintiff was found to be 10 percent negligent and his award was reduced to $315,000. Pursuant to a previous high/low agreement, the plaintiff's total award amounted to $300,000.
