Sympathetic juries in Florida favor plaintiffs
in 61 percent of personal injury cases
The likelihood of receiving a plaintiff verdict in Florida is 8 percent greater than the national rate. The plaintiff recovery probability – the number of plaintiff verdicts to total verdicts – in Florida is 61 percent compared to a 53 percent national recovery probability. Florida plaintiffs also receive awards that are larger than the national award median, according to Jury Verdict Research®’s 2007 Florida Verdict Survey.
The statistics are based on verdicts rendered in Florida from 2000 through 2006. The study also includes a breakdown of specific liability categories in the state of Florida and a settlement analysis.
