District of
Columbia plaintiff's recovery probability is
significantly greater than the national rate
The likelihood of a plaintiff verdict
in District of Columbia is 13 percent greater than the national
rate. The plaintiff recovery probability - the number of
plaintiff verdicts to total verdicts - in District of Columbia
is 68 percent compared to a 55 percent national recovery
probability, according to Jury Verdict Research®'s 2005
District of Columbia Verdict Survey. District of Columbia
plaintiffs, however, receive approximately half of the national
award rate.
The statistics are based on verdicts rendered in District
of Columbia from 1998 through 2004. The study also includes
a breakdown of specific injury and liability categories
in the state of District of Columbia.
The following table outlines the most frequently reported
liabilities in District of Columbia and the percentage of
the total number of combined plaintiff and defense verdicts
in each category.
The median is the middle value among
awards listed in ascending order. This value provides the
most accurate gauge of the norm for a specific sampling
of jury award data.
