Minnesota Plaintiff's
Recovery Probability is Greater than the National Rate
The likelihood of a plaintiff verdict
in Minnesota is 18 percent greater than the national rate.
The plaintiff recovery probability - the number of plaintiff
verdicts to total verdicts - in Minnesota is 73 percent
compared to a 55 percent national recovery probability,
according to Jury Verdict Research®'s 2005 Minnesota
Verdict Survey.
The statistics are based on verdicts rendered in Minnesota
from 1998 through 2004. The study also includes a breakdown
of specific injury and liability categories in the state
of Minnesota.
The following table outlines the most frequently reported
liabilities in Minnesota and the percentage of the total
number of combined plaintiff and defense verdicts in each
category.
The median is the middle value among
awards listed in ascending order. This value provides the
most accurate gauge of the norm for a specific sampling
of jury award data.
