Plaintiff's Recovery Probability
Slightly More than the National Rate
The likelihood of a plaintiff verdict
in 2003 rises by 5 percent from 2002, while the overall
plaintiff recovery probability - the number of plaintiff
verdicts to total verdicts - for Washington is 59 percent
compared to a 55 percent national recovery probability,
according to Jury Verdict Research®'s 2005 Washington
Verdict Survey.
The statistics are based on verdicts rendered in Washington
from 1998 through 2004. The study also includes a breakdown
of specific injury and liability categories in the state
of Washington.
The median is the middle value
among awards listed in ascending order. This value provides
the most accurate gauge of the norm for a specific sampling
of jury award data.
