of a plaintiff winning his case remains steady in recent
years, according to Jury Verdict Research®'s annual
report, Current Award Trends in Personal Injury -44th Edition.
This portion of the study examines the number of plaintiff
verdicts compared to the total number of verdicts. Cases
of admitted or directed liability were omitted. After steadily
climbing since 1997, the plaintiff recovery probability
has leveled off the last two years studied. (See table below)

The 53-page study of personal-injury
jury awards also reported that the compensatory jury-award
median for premises-liability cases was down considerably
from $156,398 in 2002 to $90,055 in 2003. The vehicular
liability jury-award median was up to $17,350 in 2003 compared
to $13,782 in 2002.
