Jury Verdict Research® Releases Medical Malpractice Study:
Plaintiff Recovery Probability In Personal Injury Cases Holds Steady - Above 50%

Palm Beach Gardens, Fla. - The odds of a plaintiff winning his case remains steady in recent years, according to Jury Verdict Research®'s annual report, Current Award Trends in Personal Injury -44th Edition. This portion of the study examines the number of plaintiff verdicts compared to the total number of verdicts. Cases of admitted or directed liability were omitted. After steadily climbing since 1997, the plaintiff recovery probability has leveled off the last two years studied. (See table below)

The 53-page study of personal-injury jury awards also reported that the compensatory jury-award median for premises-liability cases was down considerably from $156,398 in 2002 to $90,055 in 2003. The vehicular liability jury-award median was up to $17,350 in 2003 compared to $13,782 in 2002.

Since 1965, Current Award Trends in Personal Injury has analyzed jury-award and settlement trends for selected injuries and liabilities. Based on more than 245,000 nationwide personal-injury plaintiff and defense verdicts and settlements, the 44th Edition also includes:

  • Jury-award medians and probability ranges
  • The median number of months from incident to trial date
  • Jury-award trends for frequently claimed injuries including back strains, leg injuries and wrongful death
  • The median final offer and demand
  • State-specific jury-award data

Copies of Current Award Trends in Personal Injury - 44th Edition are available from Jury Verdict Research® for $42.50 plus $5.50 shipping/handling. To order or for more information, call 1-800-341-7874; visit www.JuryVerdictResearch.com; or
